Vacancy : Contracts Director

Overview: Provide commercial leadership and support across the Brockwell Energy Services Limited (BESL) business, assuming a lead role during contract negotiation and execution of a variety of construction and services contracts as the renewable portfolio develops.

Reporting to: Managing Director, BESL

Working with: Senior Management team, Engineering, Finance, Commercial, Construction teams and external stakeholders/contractors, as necessary.

ABOUT BROCKWELL

Brockwell Energy Ltd (BEL) was established in 2017 as a vehicle to develop and monetise a portfolio of energy assets across Scotland. BEL is a multi-technology renewables platform which has further diversified from its initial focus on Onshore Wind and Energy from Waste to also include Solar PV and battery storage projects. BEL’s model includes the origination, development, financing, and delivery of renewable projects within the UK. Due to BEL’s recent acquisition of a renewable development business BEL’s portfolio of projects has grown further with the development, financing and construction of these projects now extending out into the 2030s.

BESL is the delivery arm of BEL, providing technical, project management, contractual and commercial support during the pre-construction and construction phases of our renewable projects across the business.

This Contracts Director role will report directly to the Managing Director of the BESL business and is considered a key senior appointment, responsible for planning, developing and implementation of BEL’s contractual strategies.

THE ROLE

Provide contractual leadership and support across the BESL business including:

  • Pre-contract support (procurement, risk apportionment, contract review, contract negotiation and appraisals), determination of bankable legal positions, leading external lawyers up to financial close and the commercial management of construction claims, disputes, and defects.
  • Provide contractual leadership across BEL’s full portfolio of wind, solar and BESS and support projects as they transition from the development/consent project phase to the ready to build stage gate. The role will also include leadership of the commercial function during the construction phase and on to asset management.
  • The role will require full engagement with the supply chain and will help define (with the MD of BESL) the overarching delivery strategy, have a full understanding of the offering (contractually and technically) for each of the technology types across the supply chain.
  • The role will be a key interface with external legal counsel and the internal technical teams to ensure robust bankable employer’s requirements and contracts are developed.
  • Development of strategic partnerships and provide support as necessary to enable the execution of potential mergers, acquisitions, investments, and other significant corporate transactions.
  • Provide strategic and contract input into long term business plans.
  • Provide ongoing commercial/contract leadership and support for BEL’s MSA services agreements, supporting its Wind and EfW portfolio, both from a construction and operations perspective.


MAIN RESPONSIBILITIES

  • Assume the contractual lead during contract negotiation and execution of various contracts, ensuring favourable/market terms and conditions for the company.
  • Build and maintain strong relationships with clients, stakeholders, and industry partners.
  • Provide reports, forecasts, and presentations on contract activities to the Board of Directors, the senior management team, and investors.
  • Prepare and deliver presentations to the Board of Directors and senior management in support of any commercial strategies/processes that are added to the business.
  • Ensure services contracts are delivered professionally and comprehensively, whilst ensuring the organisation’s commercial positions are maintained.
  • Implement contract management plans and develop strategies to manage and mitigate risk.

PERSON SPECIFICATION

  • Minimum of 15 years’ experience in commercial management, preferably within the energy and construction sectors.
  • Proven track record of contract negotiation and contract management.
  • Exceptional leadership and team management abilities.
  • Excellent communication, negotiation, and presentation skills.
  • Strong commercial and financial background.
  • Ability to collaborate and build relationships at all levels of the organisation.
  • Highly adaptable and able to thrive in a fast-paced, high-growth environment.
